New Jersey employees are expected to provide “honorable service.” This means that their earned pensions can be impacted (or eliminated completely) if they are found guilty of offenses related to or unrelated to their employment.
In certain circumstances, pension forfeiture is automatic—meaning that even pleading guilty to some crimes to avoid jail time can still result in complete pension loss.
In most situations, an administrative or lesser criminal wrongdoing results in a hearing before the various pension system’s Board of Trustees (which makes the initial recommendation and finding). Our role as legal counsel is to prepare and file the appeal before the meeting and then appear to further argue our position before the Board of Trustees.
